Interviewing, Counseling & Negotiation (ICN) is a seminar in which the relationships between attorney and client and between attorney and opposing counsel are examined. It is a skills based course which will focus on the practical aspects of interviewing and counseling clients. Students will observe and practice interviewing, counseling, and negotiation. The ethical considerations of these activities will be covered.
In addition, the theories of negotiation will be explored ranging from direct negotiation with opposing counsel or parties, to formal modes of dispute resolution including arbitration, settlement facilitation and mediation.
Guest speakers will present on a variety of discussions, including client intake, interviewing witnesses, the attorney-adjuster relationship and plea bargaining.
At the end of the course students will have created a portfolio of documents used in the interviewing counseling and negotiation context.
