Case Acceptance
A variety of factors enter our decision to accept or reject a case. Educational experience for our students, our ability to competently handle the case, financial need, and balancing caseloads are major factors. However, the faculty considers all aspects of the matter before determining whether to accept the case. If the clinic does not accept the case, you will receive written notification and we will attempt to refer you to an attorney or agency that can offer assistance.
Cases the Clinical Law Program is Unlikely to Accept
We may not accept:
- Most cases requiring services outside of Bernalillo County and particularly outside the State of New Mexico. The Southwest Indian Law Clinic does not limit itself to representation in Bernalillo County.
- Cases appearing to require lengthy or complex service obligation.
- Cases requiring expertise not available in the current faculty and staff.
- Cases in which the client has access to legal services from other law offices.
- Cases that are inappropriate for law student representation.
- Cases that may result in an attorney fee award from the courts or are appropriate for contingency fee representation (cases in which the fee is paid from the judgment awarded by the court).
- Clients and/or cases that create a conflict of interest that cannot be resolved.
