Judicial Vacancies

The Constitution of New Mexico mandates conduction of Judicial selection by the Judicial Nominating Commission, a board comprised of New Mexico Judges, attorneys and citizens, chaired by the Dean of the UNM School of Law.

The Commission solicits applications, interviews and recommends candidates to the Governor of New Mexico for each judicial vacancy on either of the state appellate courts, any of the 13 state district courts, and the Bernalillo County Metropolitan Court.

Magistrate court vacancies are not subject to this process. Information about current magistrate court vacancies, and application procedures, can be found on the Governor’s website.

New Mexico Court of Appeals Nominees

The Appellate Court Judicial Nominating Commission convened on December 1, 2016 in Santa Fe, New Mexico, and completed its evaluation of the nine (9) applicants for the vacancy on the New Mexico Court of Appeals. The Commission recommends the following seven (7) applicants (in alphabetical order) to Governor Susana Martinez:

New Mexico Court of Appeals Announcement of a Second Vacancy

One vacancy on the Court of Appeals existed as of November 1, 2016, due to the retirement of The Honorable Michael D. Bustamante. The Appellant Court Judicial Nominating Commission will meet Thursday, December 1, 2016, to interview applicants for this vacancy. The deadline for applications for this vacancy has been set for Thursday, November 17, 2016 at 5:00 pm.

A second vacancy will occur on December 1, 2016 due to the retirement of The Honorable Roderick Kennedy. The Appellant Nominating Commission will meet Thursday, December 22, 2016 to interview applicants for this vacancy. The deadline for application for this vacancy has been set for Thursday, December 8, 2016 at 5:00 pm.

Alfred Mathewson, Chair of the Appellate Court Judicial Nominating Commission, invites applications for these positions from lawyers who meet the statutory qualifications in Article VI, Section 28 of the New Mexico Constitution. Applications received after the times and dates indicated will not be considered.

The Judicial Nominating Commission will meet at the New Mexico Supreme Court Building in Santa Fe, NM, to evaluate the applications for these position.

2nd Judicial District Court Nominees

The District Court Judicial Nominating Commission convened Monday, October 31, 2016, in Albuquerque, New Mexico, and completed its evaluation of five (5) applicants for the vacancy on the 2nd Judicial District Court. The Commission recommends the following three (3) applicants to Governor Susana Martinez.

Court of Appeals Announcement of Vacancy

A vacancy in the Court of Appeals Court will exist November 1, 2016, due to the retirement of the Honorable Michael D. Bustamante on October 31, 2016. Further inquiries regarding additional details or assignment of this judicial vacancy should be directed to the Chief Judge or the Administrator of the court.

Applications may be obtained from the Judicial Selection website: http://lawschool.unm.edu/judsel/application.php. The deadline for applications has been set for Thursday, November 17, 2016 at 5:00 p.m. Applications received after that date will not be considered.

Applicants seeking information regarding election or retention if appointed should contact the Bureau of Elections in the Office of the Secretary of State.

The Judicial Nominating Commission will meet beginning at 9:00 a.m. on Thursday, December 1, 2016, at the Supreme Court Building in Santa Fe, NM, to evaluate the applicants for this position. The Commission meeting is open to the public and members of the public who wish to be heard about any of the candidates will have an opportunity to be heard.
